SERVICE PRIVACY POLICY

 

Nano GW Cloud Service (Pilot version) is hereinafter referred as the "SERVICE".

 

This Privacy Policy explains the following items:

    i.      How Sony Computer Science Laboratories Inc. ("Sony", "we", "our" or "us") will read, collect, use and/or store information about your use of the SERVICE

    ii.     How you can contact us.

 

Please read this Privacy Policy and indicate whether you agree to its terms.

 

This Privacy Policy is in addition to any other privacy policy that may apply to your interactions with any Sony affiliate, subsidiary, product, software or service.

 

 

1.              About the SERVICE

The SERVICE is a cloud service which enables you to connect your own computing device such as PCs and smartphones to the cloud and "PicoGW", an open source Home Automation and Building Automation devices gateway server and its web API, developed by Kanagawa Institute of Technology, released under MIT license (https://github.com/KAIT-HEMS/node-picogw).  By using the SERVICE, you can access to PicoGW from remote locations, and on PicoGW, you can download add-ons such as plug-ins and connect your electronic devices compatible to the required protocol at home or other places.

 

 

2.              Information that the SERVICE may collect and communicate to Sony

When you use the SERVICE, the software installed for this SERVICE may read and communicate to us, for our collection, use and/or storage, the following types of information for the purposes described below in Section 3:

 

    i.      Device information

The Media Access Control address of the device connected to the SERVICE.

 

    ii.     Account information

    Information about your account which you use for the SERVICE, meaning your Google Account ID and the registered name or nickname linked to your Google Account ID, and if any, any other information of your Google Account specified in the login flow pages of Google OAuth.

 

    iii.    Application information

    Information about your NanoGW Plugin software, such as the version, and any other add-ons of PicoGW in your local network connected to the SERVICE.

 

    iv.    Public key information

    Public key information stored in your local network which the software for the SERVICE generates automatically.

 

    v.      Usage information

Information about how you use the SERVICE, which may be associated with your Google Account ID, such as the date on which you start using this SERVICE.

 

 

3.              How Sony uses your information

Sony may retain, use and disclose the information described above in Section 2 during the period of service provision, subject to applicable laws, for the following purposes:

 

    i.      Service and product provision

    To provide you with the services of the SERVICE as described above.

 

    ii.     Analysis and improvement of SERVICE

    To analyze and improve the SERVICES, including the development and introduction of new features and functions for the SERVICE.

 

    iii.    Compliance and enforcement

    To enforce and ensure compliance with the terms of service of the SERVICE and this Privacy Policy.

 

    iv.    Updates and development

    To help the SERVICE work better and provide you with updates.

 

    v.      Advertising and communication

   To send you marketing communications, ads and questionnaires regarding the SERVICE, Sony's and/or its affiliates' products, services or events.

 

By using the SERVICE, you consent to use of the information collected as described in Section 2 for the above purposes in accordance with this Privacy Policy. If you do not consent to use of your information for these purposes, you should not use the SERVICE.

 

 

4.              Who else has access to your information?

The information listed above may also be made available to other Sony companies and to third parties, as follows:

 

    i.      Sony companies

    Your information may be shared with other Sony companies for the purposes of pursuing the activities set forth in Section 3 above.

 

    ii.     Third party contractors

    Your information may be stored and/or processed by third party contractors of Sony that assist Sony in the provision and operation of the SERVICE.

 

    iii.    Business transfer

    Your information may be transferred by us as part of a transaction whereby we are transferring all or part of our business to a third party, in which case information held by us about our customers will be one of the transferred assets.

 

    iv.    Compliance

    We may retain, use and/or disclose any of your information as required or permitted by law, regulation or order, including to the police or other appropriate authorities, to investigate complaints made by or against you, or to protect or defend ourselves, or others, against illegal, criminal or harmful activities.

 

 

5.              Transfer of your information internationally

This SERVICE is available to users around the world by Sony Computer Science Laboratories Inc., which is located in Japan. Your information will be processed, stored and transferred for the purposes set forth above in Section 3 to countries outside the European Economic Area (EEA) and/or your country of residence, including Japan. Your information will be processed by staff operating outside the EEA and/or your country of residence who works for Sony or for one of our service providers and may be seen by such staff in those countries. Data protection and privacy laws in these countries may not offer the same level of protection as in the EEA and/or your country of residence and you may have fewer legal rights in relation to your information.

 

By using the SERVICE, you consent to these transfers taking place. If you do not consent to the transfer of your information, you should not use the SERVICE.

 

 

6.              Security Control Measure

Although Sony strives to protect your information by implementing security control measures and safeguards, we are unable to guarantee or warrant the security of any information transmitted to us during provision of our SERVICE or that we store on our systems or that is stored on our affiliates' or third party contractors' systems.

 

 

7.              Our Policy Regarding Children

Sony is committed to complying with all applicable laws and regulations regarding the collection, storage and use of personal information concerning children under the age of 13, including the Children's Online Privacy Protection Act in the United States and applicable local legislation in other territories.

 

If you are under the age of 13, you must obtain your parent's or legal guardian's consent to use this SERVICE. If you are a parent or guardian that has become aware that your child has provided us with personal information without your consent, you should contact us as indicated below.  We do not knowingly collect information from children under the age of 13. If we become aware that a child under the age of 13 has provided us with information, we will delete such information from our system.

 

 

8.              Privacy Rights

In some countries, including countries in the European Economic Area, you have certain rights with respect to the personal information Sony holds about you. These may include the right to request a copy of the personal information that we hold about you and/or you may request that we correct, amend, delete or block such personal information if it is inaccurate. If you would like to exercise any of these rights, please contact Sony using the appropriate contact details listed below.

 

Notice to California Residents - Your California Privacy Rights:

 

If you are a California resident, you have the right to receive: a) information identifying any third party company(ies) to whom Sony may have disclosed, within the past year, personal information pertaining to you for that company's direct marketing purposes; and b) a description of the categories of personal information disclosed. 9.              Changes to this Privacy Policy

This Privacy Policy may be updated from time to time.  We will post the revised version with an updated revision date, at https://nanogw.sonycsl.co.jp/privacypolicy.html
